This Privacy notice describes what types of personal data Motorseeker UK Limited collect from you, when and how it is collected, used and disclosed and how it is kept secure.

It is important that you read this notice so you are aware as to how we use your data.

It is important that the personal data we hold about you is accurate and current. Please keep us informed if your personal data changes.

We are registered with the ICO as a Data Controller. This means that we have the responsibility of deciding how and why data is collected and used and shared. This responsibility also means that we must comply with data protection legislation.

3. Processing another person’s personal data

If you provide us with personal data on behalf of someone else eg Spouse’s name on loan car form you must state that you have their full permission for us to process the data on their behalf.

4. What personal data do we collect about you?

Contact data – your name, home address, previous address, home telephone number including mobile, email address and work telephone numbers.

Identity data – details of your Passport, driving licence, date of birth, utility bills and national insurance number.

Financial data – details of your bank account, bank statements, payment card details, vehicle purchase agreement, employment history and salary.

Transaction data – details about payments to and from you and other details of products that you have purchased from us.

Website data – our web server will store standard details of your browser and operating system, the website that you have landed to our website from, date of visit, web browsing behaviour, demographics and IP address assigned to you.

Location data – details of your travel history or home address will be collected if your vehicle has a Tracker fitted or Sat Nav systems.

Image data – photographic data collected on our cameras when you visit our premises.

Vehicle data – details of your number plate is collected on CCTV. We retain details of your vehicle on our systems after purchase and or service or repair.

Audio data – details of telephone calls maybe recorded for monitoring, dispute resolution.

Social network data – detail of personal data that is part of your public profile on a third party social network may also be collected.

Family data – details of members of your family may be collected when you purchase a vehicle for them.

Public Authority data – information held by DVLA including penalties you may have on your driving licence.

5. If you fail to provide personal data

Where we need to collect personal data by law, or under the terms of a contract we have with you and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services). In this case, we may have to cancel a product or service you have with us but we will notify you if this is the case at the time.

6. Where do we get your personal information from?

Personal data you have given to us. We collect personal data when you provide this to us directly in the scenarios listed below:

- by entering personal data via our websites, live chat boxes or social media platforms and through testimonials and opinions you may have posted publically on our websites or social media platforms;

- when you place any order for our goods, products or services for example when you purchase a vehicle or book an appointment for your vehicle to be serviced.

- when you apply for a loan, personal contract purchase or lease agreement from one of our accredited finance providers to purchase your vehicle

- when you part exchange your vehicle and provide full service history of that vehicle;

- when you provide documents to evidence your vehicle is covered by a valid insurance policy;

- when you respond to an advertisement or any other promotional communication we may have sent to you;

- by corresponding with us by phone, email, in person or otherwise (for example via social media) for any other purpose.

Personal data we may receive from finance providers and brokers. We collect the personal data from finance providers in the scenarios listed below:

- If you have engaged a third party broker to act on your behalf to administer the purchase of a vehicle;

Personal data we may receive from regulatory bodies. We collect personal data from regulatory bodies in the scenarios listed below:

- from the Driver and Vehicle Licencing Agency (DVLA) to confirm if you hold a valid driving licence to allow the provision of a loan car or a test drive.

Personal data we may receive from other public sources. We collect the personal data from the following public sources in the scenarios listed below:

- to assist the police or other public authorities with their enquiries and/or investigations.

7. Sharing your personal information with third parties

We share your personal data for:

-sending communications to customers

-accounting purposes

-to handle complaints or provide information you have requested

-administer your finance application on your behalf

-allow you to facilitate funding to purchase a vehicle

We do not sell your personal information to third parties, however we may disclose your information to third parties eg DVLA or in other situations where we have a duty to disclose.

8. Why we process your personal data

- When you are making an enquiry or negotiating to buy a vehicle – responding to queries you may have

- When you provide your personal detail to a third party website eg AutoTrader your data is forwarded onto us to answer your request

- To arrange a test drive – we have a legal obligation to check driving licence credentials

- Photographic images that we collect via CCTV when you visit our premises.

- When you purchase a vehicle – completion of all mandatory paperwork and make payment

- If you are part exchanging / selling a vehicle to us we will check your vehicle details via CAP / HPI includes mileage, outstanding finance and service history before making an offer to buy it.

- Purchasing a vehicle on finance – administer and arrange for you to purchase/lease a vehicle

- Completion of all documents for us to be compliant with Financial Conduct Authority.

- If finance is declined we will let you know this before sending to another lender for consideration.

- Vehicle maintenance and servicing – to contact you to make an appointment for service or repair work.

- To collect or deliver your vehicle we need your address details

- Arranging courtesy vehicle we will need driving licence credentials

- Contacting you with ongoing maintenance matters or safety recalls

9. Processing to enable us to promote our business and our products

If you are an existing or new customer we will send you promotional or marketing information giving you news of special offers etc.

If you do not have an existing relationship with us then we will only send you marketing communications if you have chosen to opt in.

We will contact you through forms of social media unless you object to it.

There may be occasions where you collect your vehicle from our site that will record CCTV images.

Processing of your data in order that we can effectively administrate enquiries, complaints or claims.

To keep you informed of any updates to our policies and procedures.

10. Your rights under Data Protection legislation

- The right to request access – this entitles you to request a copy of data that we hold on file.

- The right to request correction – this enables you to inform us of any incorrect or incomplete information held by us about you.

- The right to request erasure – This enables you to ask us to remove or delete personal data we hold about you.

- The right to object to processing – this permits you to object to us processing your information as in your opinion it affects your fundamental rights.

- The right to request restriction – this permits you to request suspending the processing of your data eg you have a legitimacy claim on it.

- The right to request the transfer – only applies when you have provided consent for the use of it so we can perform a contract with you.

- Monitored access to IT systems which are password protected.

12. Using your data for marketing and how to opt out

We may contact you because you have previously enquired about one of our products. However you have the right to opt out of receiving such communications by changing your preferences. You can do this in the following ways:

13. How long do we keep your personal data?

We will retain it as long as it is necessary for the purpose that we obtained it. If you have previously purchased one of our products we will retain it for up to 6 years. Where you enquired but did not buy one of our products, it will be deleted after 3 years.

Our website may include links to third party websites. Clicking on those links may allow third parties to collect or share data about you. We encourage you to check the respective Privacy Statement of every website you subsequently visit.
